Retirement Benefits Required by Virginia Employers: If an employer has 25 or more employees, and has been established beyond two years, they must offer a retirement plan OR they can register for RetirePath, an IRA program created by Virginia to expand access to retirement savings and economic security.

 

Health Benefits Required by Virginia Employers: As stated above, Virginia state law does not require health benefits be provided to employees, however, Federal Law (the ACA) mandates that Virginia employers provide health benefits to employees if they have 50 or more full time employees.

 

Leave Required by Virginia Employers: Employees are entitled to time off in certain situations such as, sick leave, medical and family matters, jury duty, military obligations, and crime victim leave.

 

Other Benefits: Virginia employers must also provide unemployment benefits and workers compensation.

 

Employer/Employee Rights: Virginia is an at-will employment state with right to work laws. At-will means that employers and employees can end their relationship anytime, for any reason, without notice. Right to work means an employer can’t discriminate against an employee for participation, or non-participation in a labor union. Other rights include compensation for whistleblower information under the Virginia Fraud Against Tax Payers Act, and equal pay which prohibits business owners from discriminating on the basis of various criteria, specifically race, religion, sex, sexual orientation, gender identification or expression, political affiliation, national origin, marital status, veteran status, disability, or age.

 

Wage Laws: Minimum wage in Virginia is currently $12 per hour. It will increase to $13.50 per hour in January 2025 and to $15 per hour in January 2026. Non-exempt employees must receive 1.5 times regular pay for hours worked over 40 hours in a week.

 

Drug Laws: Employers cannot punish or fire employees for using cannabis as long as it doesn’t affect their work. However, employers can take action if employees use or possess marijuana during work hours. Employers can drug test and fire employees for drug use other than cannabis.
